By accessing this website or engaging Klear Estates, LLC for services, you agree to these Terms of Service. If you do not agree, please do not use the site.
2. Our Services
Klear Estates provides estate liquidation, estate sale management, consignment, cleanout, and appraisal services. The specific terms of any engagement — including commissions, fees, and duration — are governed by a separate written agreement (Estate Sale Agreement or Consignment Agreement) signed by both parties. In the event of a conflict, the signed agreement controls.
3. Website Accounts & Registration
Sale notification sign-ups and line reservations are provided for convenience. You agree to provide accurate information and are responsible for maintaining the confidentiality of any account credentials. We may suspend accounts used in violation of these terms.
4. Purchases at Estate Sales
All items at estate sales are sold as-is and where-is, with no warranties expressed or implied. All sales are final — returns, exchanges, and refunds are not offered unless required by law. Prices are subject to change as posted during the sale. We accept cash and major credit cards; returned checks and declined payments may incur additional fees.
5. Line Management
Our online line system assigns you a position and texts you when it is your turn to enter. Signing up does not guarantee entry at any specific time; spots may be forfeited if you do not respond within the window given in the notification. Message and data rates may apply. Reply STOP to any message to opt out.
6. Intellectual Property
All content on this website — text, photography, logos, and design — is the property of Klear Estates, LLC and may not be reproduced without written permission.
7. Limitation of Liability
To the fullest extent permitted by law, Klear Estates, LLC is not liable for indirect, incidental, or consequential damages arising from use of this website. Our total liability for any claim related to our services is limited to the fees paid for the specific engagement giving rise to the claim.
8. Governing Law
These terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Cook County, Illinois.
